YOU AGREE TO BE BOUND BY OUR TERMS AND CONDITIONS. 

​1. General conditions 
1.1. This agreement is an official and public offer of ​​​MAGHELP.ME to enter into an agreement for the provision of individual and informational Services presented on the website https://maghelp.me. 
1.2. This contract is public, that is, in accordance with Article 633 of the Civil Code of Ukraine, it publicly offers a wide and unlimited range of persons (individuals) - "Customers" the opportunity to receive individual and informational services defined by this Contract (according to the text "Contract" or "Public Contract") (according to the text - "Services"), provided offline or via the Internet, including using messenger applications (Telegram, Skype, Zoom, Viber, other and/or social networks). 
1.3. The terms of the Agreement are the same for all customers, without favoring one customer over another. 
1.4. By concluding this Agreement, the Customer fully accepts the terms and conditions of placing an order, paying for services, fulfilling an order, refunding funds, liability for an unscrupulous order and all other terms of the agreement.
1.5. The contract is considered concluded from the moment the "Pay" button is clicked on the order page and the Customer receives an electronic order confirmation from ​​MAGHELP.ME. 

2. Definition of terms 
2.1. Contract - Public Offer (hereinafter - "Offer") - an electronic contract for the provision of Services concluded between ​​​MAGHELP.ME​ and the Customer, as a result of the latter's acceptance of the Offer, executed in electronic form.  
2.2. ​MAGHELP.ME – Individual entrepreneur Dragomirov V.A., registered in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations on October 25, 2023, record number: ​2010350000000434866, valid on the basis of the Extract from Unified State Register of Legal Entities of Individual Entrepreneurs and Public Organizations. 
2.3. The customer is any natural person (citizen) who has reached 18 years of age, has civil legal capacity and full civil legal capacity, and wishes to receive the Services specified in this Agreement. 
2.4. The parties are the Customer and/or ​MAGHELP.ME. 
2.5. Services - within the framework of this Agreement, individual and informational services are understood regarding problems, feelings, goals, desires, any issues, the presence of which determines the Customer's need for ​​MAGHELP.ME services provided remotely. The essence of ​MAGHELP.ME services is Tarot card reading, diagnostics, astrological and spiritual sessions. 
2.6. Payment system — within the meaning of this Agreement, a payment organization or payment service (Fondy, WayForPay or others) that ensures the transfer of funds between the payer and the recipient (the Customer and ​​​MAGHELP.ME). 
2.7. An invoice is a document that specifies the goods and services that ​​MAGHELP.ME provides to the Customer, and specifies the Customer's obligation to pay for these services. 
2.8. Site – Web pages on the Internet located at the address https://maghelp.me, and created for the conclusion of contracts for the provision of individual services based on the Customer's familiarization with the description of Services proposed by ​​​MAGHELP.ME.

3. Subject of the Agreement 
3.1. The Customer undertakes to pay for and accept the Service under the terms of this Agreement, and ​​​​MAGHELP.ME undertakes to transfer the Service to the Customer. 
3.2. The date of conclusion of the Contract-offer (acceptance of the offer) and the moment of complete and unquestionable acceptance by the Customer of the terms of the Contract shall be considered the date of payment by the Customer of the order placed on the Site or the Invoice received from ​​​MAGHELP.ME in electronic form. 
3.3. This Agreement is concluded exclusively in electronic form. 

4.  Placement of the Order  
4.1. The customer places an order independently on the ​​​MAGHELP.ME website, or by placing an order by e-mail or using the link indicated in the contact section of the Site. 
4.2. ​​​​MAGHELP.ME has the right to refuse the execution of the order in case the information provided by the Customer during the order placement is incomplete or raises suspicions about their validity.
4.3. When placing an order on the Site, the Customer undertakes to provide the following mandatory information required by ​​​MAGHELP.ME to fulfill the order:
      4.3.1. last name, first name of the Customer;
      4.3.2. e-mail address (Email);
      4.3.3. contact phone        
      4.3.4. clearly formulated question.
      4.3.5. a link to the Instagram page (if available).
4.4. If any of the parties to the contract needs additional information, he has the right to request it from the other party. If the Customer does not provide the necessary information, ​​​MAGHELP.ME is not responsible for providing quality service to the Customer. 
4.5. The Customer's acceptance of the terms of this Offer is carried out by the Customer entering the relevant data in the registration form on the Site or by paying the Invoice received from ​​​​MAGHELP.ME in electronic form.
4.6. The Customer is responsible for the accuracy of the information provided when placing the Order.
4.7. By concluding the Agreement, i.e. accepting the terms of this offer (proposed terms of purchase of the Service), by placing an Order, the Customer confirms the following:
a) The Customer is fully and completely familiar with and agrees with the terms of this offer (offer);
b) he gives permission for the collection, processing and transfer of personal data, the permission for the processing of personal data is valid for the entire term of the Agreement, as well as for an unlimited period after its expiration. In addition, by concluding the contract, the Customer confirms that he has been notified (without additional notification) of the rights established by the Law of Ukraine "On the Protection of Personal Data", the purposes of data collection, as well as the fact that his personal data is transferred to ​MAGHELP.ME for the purpose the possibility of fulfilling the terms of this Agreement, the possibility of carrying out mutual settlements, as well as for receiving invoices, acts and other documents. The Customer also agrees that ​​​​MAGHELP.ME has the right to provide access and transfer his personal data to third parties without any additional notifications from the Customer for the purpose of fulfilling the order. The extent of the Customer's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" is known and understood by him.

5. Cost of services and payment procedure 
5.1 Prices for services are determined by ​​​MAGHELP.ME independently, presented on the Site and/or in accordance with the first part of Article 632 of the Civil Code of Ukraine, set by agreement of the parties. 
Payment for individual services is made after taking into account all the wishes of the Customer and agreeing on the final price for the services, through an additional verbal agreement. 
Confirmation of price agreement is 100% Payment of the service by the Customer, on the Site page or payment of the Invoice received by the Customer from ​​​MAGHELP.ME via the Internet, including using messenger applications (Telegram, Skype, Zoom, Viber, other and/or social networks ).
5.2. All prices for Services are provided in hryvnias, excluding VAT. 
5.3. Prices for Services may be changed unilaterally by ​​​MAGHELP.ME depending on market conditions. At the same time, the price of a separate unit of the Service, the cost of which has been paid in full by the Customer, cannot be changed unilaterally by ​​​MAGHELP.ME. 
5.4. The customer has the opportunity to send payment using any payment service method (bank card, Google Pay, Apple Pay, etc.). When paying, an additional payment service fee may be charged. 
5.5. The Customer's obligations to pay for the Services are considered fulfilled from the moment the funds are received on the account of ​​​​MAGHELP.ME. By making the payment, the Customer confirms that he has voluntarily transferred the funds to MAGHELP.ME and that all services have been provided to the Customer in full.
5.6. Payments between ​​​​MAGHELP.ME and the Customer for the Service are made in the following ways:      
     - through the payment form on the page SERVICES.      
     - payment according to the Invoice received from ​​​MAGHELP.ME in electronic form. 
When paying for an order by bank card, payment processing (including entering the card number) takes place on a secure page of the Bank's processing system. This means that confidential data (card details, registration data, etc.) are not transferred to the Service site, their processing is fully protected and no one can obtain the User's personal and bank data. 
5.7. The Parties agree to consider the date of receipt of funds at the disposal of ​​​​MAGHELP.ME as the date of payment.    

6. Terms and procedure for providing services 
6.1. ​​​​MAGHELP.ME provides services in accordance with the terms of this Agreement. 
6.2. Tarot reading is provided within 1-5 days from the date of receipt of payment from the Customer. The term can be extended in case of a large queue or as a result of force majeure, but not more than 10 days. If it is impossible to fulfill the order within the specified period, ​​MAGHELP.ME undertakes to return the paid funds, excluding the bank commission. 
6.3. Esoteric and other services are provided on a first-come, first-served basis, in terms agreed personally between ​​​MAGHELP.ME and the Customer.
6.4. The term of the start/end of the execution of the order is the remote provision to the Customer, via the Internet, including using messenger applications (Telegram, Skype, Zoom, Viber, other and/or social networks), a photo/video recording of the results of the order execution. 
6.5. The results of the services are provided "AS IS" and may not match the Customer's personal expectations. 
6.6. Payment for the ordered services means sufficient and complete familiarization of the Customer with the characteristics of the paid individual and/or information services, information about the terms of their provision, expected volumes, all information and information, the provision of which is necessary for the Customer to make a conscious and considered choice. As well as familiarization with the content and volume, cost and method of its determination, terms, order and characteristics of the provision of ​​MAGHELP.ME services under this Agreement, with the content of this Agreement in full and in an accessible form.
  
7. Rights and obligations of the Parties 
7.1. ​​​MAGHELP.ME is obliged to: 
7.1.1. Transfer to the Customer the results of the service performance in accordance with the terms of this Agreement and the given order. 
7.1.2. Not to disclose any private information about the Customer and not to provide access to this information to third parties, except for cases provided by law and during the execution of the Customer's order. 
7.2. ​​​​MAGHELP.ME has the right: 
7.2.1 To unilaterally change the terms of this Agreement, as well as the prices of the Services, by posting them on the Site. All changes take effect from the moment of their publication. 
7.3 The customer undertakes: 
7.3.1 Before concluding the Agreement, familiarize yourself with the content of the Agreement, the terms of the Agreement and the prices offered by ​​​MAGHELP.ME on the Site and/or in the personal calculation of the cost of the order. 
7.3.2 In order to fulfill ​​​MAGHELP.ME obligations to the Customer, the latter must provide all the necessary data that uniquely identify him as the Customer and are sufficient to provide the Customer with the ordered Service.     

8. Service refusal and refund
8.1. The customer has the right to refuse the service and request a refund. In order to be entitled to a refund, the Customer must notify ​​​​MAGHELP.ME before the start of the order. 
8.2. The customer does not have the right to refuse the service, if the order is taken into operation (is in the process of execution or has already been executed), the determination of the start of execution of the order is governed by clause 6.4. of this Agreement. 
8.3. If the Customer's personal expectations do not coincide with the result of the service, according to Clause 6.5 of this Agreement, this cannot be a reason for compensation. 
8.4. The cost of the Service will be refunded to the Customer within 30 (thirty) calendar days from the moment ​​​MAGHELP.ME receives the Customer's refusal of services, subject to compliance with the requirements stipulated in clauses 8.1.- 8.3. Agreement. 
8.5. The cost of the Service is subject to refund by bank transfer to the Customer's account, minus the funds spent on preparing the order (purchase of necessary materials and ingredients, payment for the services of third parties involved in the fulfillment of the terms of the order... etc.). 
8.6. Submitting a request for service refusal and reimbursement in cases provided for by law and this Agreement is carried out at the email address indicated on the ​​​​MAGHELP.ME website in the "Contacts" section. 

9. Liability and limitation of liability
9.1. ​​MAGHELP.ME is not responsible for the consequences caused to the Customer or third parties as a result of the execution of the Order received from the Customer.
9.2. ​​MAGHELP.ME is not responsible for improper, untimely fulfillment of Orders and its obligations in the event that the Customer provides inaccurate or erroneous information.
9.3. The parties are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement. 
9.4. The Customer releases ​​​MAGHELP.ME from responsibility for any losses, damages, fines, other additional costs, including legal aid costs, which arose as a result of the Customer's violation of the provisions of this Agreement, the requirements of the legislation of Ukraine.
9.5. The parties are released from responsibility for full or partial non-fulfillment of their obligations, if the non-fulfillment is the result of force majeure circumstances such as: war or hostilities, earthquake, flood, fire and other natural disasters that occurred independently of the will of ​​​MAGHELP.ME and/or the Customer after concluding this contract. A Party that cannot fulfill its obligations shall immediately notify the other Party thereof.     

10. Confidentiality and protection of personal data.  
10.1. By providing his personal data on the Site when registering or placing an Order, the Customer gives ​​​MAGHELP.ME his voluntary consent to the processing, use (including the transfer) of his personal data, as well as taking other actions provided for by the Law of Ukraine "On the Protection of Personal Data ", without limiting the validity period of such consent. 
10.2. ​​​​MAGHELP.ME undertakes not to disclose the information received from the Customer. It is not considered a violation to provide ​​​​MAGHELP.ME with information to counterparties and third parties acting on the basis of a contract with ​​​​MAGHELP.ME, including for the fulfillment of obligations to the Customer, as well as in cases where the disclosure of such information is established by the requirements of current legislation of Ukraine. 
10.3. The customer is responsible for keeping his personal data up-to-date. ​​​​MAGHELP.ME is not responsible for poor performance or non-fulfilment of its obligations in connection with the irrelevance of information about the Customer or its inconsistency.  
  
11. Confirmation from the Customer 
11.1. The customer, accepting this Agreement, confirms the following:      
- he is a person with legal capacity, no court proceedings have been initiated against him regarding recognition of legal capacity or limited legal capacity;      
- at the time of registration or in case of other action regulated by this Agreement, agrees to the processing of his personal data, in accordance with the purposes specified in this Agreement and its annexes;      
– The Customer voluntarily gives his unconditional consent to the processing by ​​​MAGHELP.ME, any involved third parties in connection with the execution of this Agreement by persons of personal, medical and other data received from the Customer as a result of legal relations under this Agreement, as well as unconditional consent to saving the history of the Customer's communication with ​​​MAGHELP.ME using any memory devices. Processing includes, but is not limited to, collection, registration, accumulation, storage, adaptation, renewal, use and distribution (including transmission), destruction of data processed by ​​​​MAGHELP.ME;      
- The customer is aware that the services received in accordance with the terms of this Agreement cannot be considered as medical or psychological assistance. To receive medical assistance and other types of medical care, it is necessary to contact a doctor or a health care institution;      
- will adhere to the assurances set forth above in this clause of the Agreement. The specified assurances are considered to be repeated every time when services are provided (received by the Customer) from ​​MAGHELP.ME and during the term of this Agreement;      
- The customer fully and completely agrees with clauses 8.2-8.3. of this Agreement, and will not have any claims to ​​MAGHELP.ME, regarding the refund after the start of the order execution.      

12. Other conditions 
12.1. This contract is concluded on the territory of Ukraine and is valid in accordance with the current legislation of Ukraine. 
12.2. All disputes arising between the Parties shall be resolved through negotiations. In case of failure to reach a settlement of the disputed issue through negotiations, the Customer and/or ​​MAGHELP.ME have the right to apply for a resolution of the dispute to the judicial authorities in accordance with the current legislation of Ukraine. 
12.3. ​​​​MAGHELP.ME has the right to make changes to this Agreement unilaterally, provided for in clause 7.2.1. Agreement. In addition, changes to the Agreement may also be made by mutual agreement of the Parties in accordance with the procedure provided for by the current legislation of Ukraine.     

13. Final provisions 
13.1. The parties claim that the conclusion of this Agreement is aimed at the actual occurrence of legal consequences, which are determined by it; 
13.2. The will of the Parties is free and corresponds to their inner will and valid intentions; this Agreement does not have the nature of a fictitious and pretended deed; 
13.3. The customer agrees with the prices and costs specified by ​​​MAGHELP.ME, with the procedure and conditions of payment for services, the procedure for approving changes to the terms of the Agreement; 
13.4. The parties claim that they are fluent in the Ukrainian language, in which the terms of the Agreement are set out, which gave them the opportunity to read and correctly understand the content of this Agreement. 
13.5. The Customer certifies that prior to the conclusion of this Agreement, it has received in full, in a clear, understandable manner, all the necessary, available, reliable and timely information and which is necessary for the Customer to make a conscious choice and make an informed decision about accepting the terms of this Agreement. 
13.6. Assignment of the right to demand and (or) transfer of the debt under this Agreement by the Customer to third parties is allowed only with the prior written consent of ​​​MAGHELP.ME.
